Terms and conditions for MEDCAN Association website

1. Use of the website

1.1 These General Terms and Conditions apply to members of the Medical Cannabis Association Switzerland as well as other users and visitors to the website.

1.2 Members and sponsors can participate in the discussion forum and use the Association 's services offered via the website.

1.3 If desired, the company members of the Association can publish their logo on the website and have their own website linked.

1.4 You can register as a new member of the Association via the website.

 

2. Finance

2.1 The membership fees are CHF 50 and are billed annually. The billing will be sent by email. Registration as a member takes place as soon as the membership fee has been paid.

2.2 The fees can currently only be paid via the Postcheck account.

2.3 Costs related to the payment procedure, e.g. bank fees, are borne by the members.

 

3. Liability

3.1 Members and other visitors to the website are aware that even with careful software development and maintenance, errors can occur, so that the Association cannot guarantee 100% availability of the service.

3.2 For maintenance, security or capacity reasons, the Services may be temporarily suspended or limited. In the event of foreseeable interruptions, visitors will find corresponding information on the website.

3.3 The Association limits its liability to damages that are attributable to intentional breaches of contract or gross and moderate negligence on the part of the board members responsible for the website or their auxiliary persons. If any defects or disruptions arise, members should report these immediately.

3.4 The Association is not liable for defects and disruptions for which it is not responsible, in particular not for security deficiencies and operational failures of third-party companies with which it works or on which it is dependent.

3.5 Furthermore, the Association is not liable for force majeure, improper action and disregard of the risks on the part of members or third parties, excessive use, unsuitable operating resources of members or third parties, extreme environmental influences, interventions by members or disruptions by third parties (viruses, worms, etc.), that happen despite the necessary current safety precautions.

3.6 The Association is not liable for a breach of duty by a member towards another member due to Association agreements and contracts concluded between them. The members are responsible for their own business and private communication with each other.

3.7 Under no circumstances will the Association assume any liability towards members for direct or indirect damages or disadvantages arising from the use and content of the information published via the platform or the transmission of the relevant information on the Internet.

4.8 Members and visitors must note that the authentication of Internet users cannot be absolutely guaranteed, even if members' details are checked before registration. The Association does not guarantee that the participants in the discussion forums, the linked websites and the banner advertising are actually the people named. Anyone who contacts other users via the website should verify the identity of the person concerned.

 

4. Data protection and processing of data

4.1 The Association undertakes to comply with the provisions of the Data Protection Act and the Data Protection Regulation.

4.2 The members provide the Association with all information required for the contractual services and guarantee that all data provided by them is true and complete. The members communicate any address changes and other necessary information immediately.

4.3 The data transmitted by members will in principle only be used within the scope of or for the purposes of fulfilling the contract and in the interests of the Association and its members.

4.4 The Association processes and uses members' personal data, such as name, password and email address, for the implementation and processing of its offer as set out in the statutes and these General Terms and Conditions.

4.5 The members acknowledge that the usage data is processed, among other things, with the help of cookies, for example to assign a user ID.

4.6 If a member leaves, all of their data on the website will be deleted at their request.

4.7 The Association may process members' data if it is necessary to detect and stop fraudulent information provided as well as unlawful or contractual use or misuse of the Association or the website. For this purpose, the Association may also determine and process usage data, including with the help of cookies, in order to find out from the total inventory of all current information those for which there is actual evidence of misuse. This also applies if the person in question is no longer a member of the Association . The Association may transmit this data to law enforcement authorities and third parties whose rights have been violated.

 

5. Commitment of Members

5.1 The members procure at their own expense the facilities they need to open a web account (hardware, software).

5.2 When registering, members receive a password. You are obliged to keep these passwords secret.

5.3 Members must secure their systems so that they do not become a source of danger for others.

5.4 It is generally the responsibility of members to create backup copies of their data. Data available on the server is backed up regularly. This backup represents an image at a certain point in time.

5.5 Members are responsible for ensuring that the address names they choose (domain, email addresses) are free and do not violate the rights of third parties.

5.6 It is not permitted to pass on the Association 's services to third parties, whether for a fee or free of charge, or to allow third parties to access the discussion forum.

5.7 Members may not use any mechanisms, software or other scripts in connection with the use of the Website. Members are strictly prohibited from blocking, overwriting, modifying or copying platform content.

5.8 The Association accepts no responsibility for damages arising as a result of Members failing to fulfill the obligations set out in clauses 5.1 to 5.7.

5.9 The Association reserves the right to block admission if a member violates the obligations stated in Sections 5.1 to 5.7. In minor cases the member may be warned.

 

6. Commitment to lawful conduct

6.1 The members undertake not to bother other members or other website users with unwanted communication attempts and advertising.

6.2 Members are obliged to follow the applicable legal regulations when dealing with other members, e.g. not to send chain letters or fraudulent offers.

6.3 The data and information published on the platform must not violate personal rights, press law, copyright, competition law and regulations on trademarks and design as well as other Swiss legal regulations. Where necessary, international law and, in any case, netiquette must also be taken into account.

6.4 The Association reserves the right to block use immediately if the content of a publication on the platform is illegal or seriously violates netiquette. In more serious cases, the Association may request members to amend the publication. If this is not adhered to, the possibility of use will be blocked. If there is criminal content, the police will be informed.

6.5 In the event of breaches of duty in accordance with Sections 6.1 to 6.4, the Association has the right to claim damages. If Internet access is blocked, the Association is not required to refund prepaid contributions.

 

7. Security

7.1 The Association undertakes to ensure state-of-the-art security in systems, programs, etc. over which it has influence.

7.2 Members must ensure the security of the systems, programs and data that are within their sphere of influence. In their own interest, members should keep passwords and user names secret from third parties, change passwords at regular intervals if necessary and design them in such a way that they cannot be easily determined.

7.3 The members undertake not to create an excessive burden on the platform through untargeted or improper distribution of data, in particular to refrain from spam mailing.

7.4 Members must refrain from archiving or spreading computer viruses.

7.5 If members breach their obligations in accordance with Sections 7.3 and 7.4, the Association may immediately block access without refunding any prepaid amounts and, if necessary, demand compensation.

 

8. Changes to the Terms and Conditions

8.1 The board of the Association can adapt these terms and conditions at any time and without giving reasons as far as the management and technology of the website are concerned.

8.2 The changed conditions will be sent to members by email no later than two weeks before they come into force.
