Terms and Conditions for the MEDCAN Association website
1. Use of the website
1.1 These terms and conditions apply to the members of the Medical Cannabis Association Switzerland as well as to other users and visitors of the website.
1.2 Members and sponsors can participate in the discussion forum and use the services of the Association offered via the website.
1.3 Upon request, the company members of the Association can publish their logo on the website and have their own website linked.
1.4 New members can register via the website of the Association .
2. Finances
2.1 The membership fee is CHF 50 and is billed annually. The invoice will be sent by email. Registration as a member will take place once the membership fee has been paid.
2.2 The fees can currently only be paid via the postal checking account.
2.3 Members shall bear any costs associated with the payment process, e.g. bank fees.
3. Liability
3.1 The members and other visitors of the website are aware that even with careful software development and maintenance, errors can creep in, so the Association cannot guarantee 100% availability of the service.
3.2 For maintenance, security, or capacity reasons, services may be temporarily suspended or restricted. Visitors will find relevant information on the website regarding foreseeable interruptions.
3.3 The Association limits its liability to damages resulting from intentional breaches of contract or gross and ordinary negligence on the part of the board members responsible for the website or their assistants. Members should report any defects or malfunctions immediately.
3.4 The Association shall not be liable for defects and malfunctions for which it is not responsible, in particular for security defects and operational failures of third-party companies with which it cooperates or on which it depends.
3.5 Furthermore, the Association shall not be liable for force majeure, improper conduct and disregard of risks on the part of members or third parties, excessive use, unsuitable equipment of members or third parties, extreme environmental influences, interventions by members or disruptions caused by third parties (viruses, worms, etc.) that occur despite the necessary current security precautions.
3.6 The Association is not liable for any breach of duty by one member towards another member arising from Association agreements and contracts concluded between them. Members are responsible for their own business and private communications with one another.
3.7 The Association shall under no circumstances accept any liability towards members for direct or indirect damages or disadvantages arising from the use and content of the information published via the platform or the transmission of the relevant information on the Internet.
4.8 Members and visitors should be aware that the authentication of internet users cannot be absolutely guaranteed, even though members' information is checked before registration. The Association does not guarantee that the individuals behind the participants in the discussion forums, on the linked websites, and in the banner advertisements are actually the persons named. Anyone contacting other users via the website should verify the identity of the individuals in question themselves.
4. Data protection and data processing
4.1 The Association undertakes to comply with the provisions of the Data Protection Act and the Data Protection Regulation.
4.2 Members shall provide the Association with all information necessary for the contractual services and guarantee that all data they provide is true and complete. Members shall promptly notify the Association of any changes of address and other necessary information.
4.3 The data transmitted by the members will in principle only be used within the framework or for the purposes of fulfilling the contract and in the interest of the Association and its members.
4.4 The Association processes and uses personal data of its members, such as name, password and email address, for the execution and processing of its services as defined in the statutes and these terms and conditions.
4.5 The members acknowledge that usage data is processed using cookies, for example to assign a user ID.
4.6 Upon a member's departure, all their data will be deleted from the website at their request.
4.7 The Association may process members' data if this is necessary to detect and prevent fraudulently provided information, as well as unlawful or unauthorized use or misuse of the Association or its website. For this purpose, the Association may also collect and process usage data, including through the use of cookies, to identify from all current information those instances where there are concrete indications of misuse. This also applies if the person in question is no longer a member of the Association . The Association may transmit this data to law enforcement agencies and to third parties whose rights have been violated.
5. Obligations of the members
5.1 Members shall procure at their own expense the equipment they require to open a web account (hardware, software).
5.2 Upon registration, members receive a password. They are obliged to keep these passwords secret.
5.3 Members must secure their systems in such a way that they do not become a source of danger to others.
5.4 It is generally the responsibility of the members to create backups of their data. Data stored on the server is backed up regularly. This backup represents a snapshot at a specific point in time.
5.5 Members are responsible for ensuring that the address names (domain, email addresses) they choose are available and do not infringe on the rights of third parties.
5.6 It is not permitted to pass on the services of the Association to third parties, whether for a fee or free of charge, or to allow third parties access to the discussion forum.
5.7 Members may not use any mechanisms, software, or other scripts in connection with the use of the website. Blocking, overwriting, modifying, or copying content from the platform is strictly prohibited for members.
5.8 The Association accepts no responsibility for damages arising because members fail to comply with the obligations set out in sections 5.1 to 5.7.
5.9 The Association reserves the right to suspend membership if a member violates the obligations set out in sections 5.1 to 5.7. In minor cases, the member may be issued a warning.
6. Obligation to conduct lawfully
6.1 Members agree not to harass other members or other website users with unsolicited communication attempts and advertising.
6.2 Members are obliged to comply with applicable legal regulations when dealing with other members, e.g. not to send chain letters or fraudulent offers.
6.3 The data and information published on the platform must not infringe upon personal rights, press law, copyright, competition law, regulations concerning trademarks and designs, or other legal provisions of Switzerland. Where necessary, international law and, in any case, netiquette must also be observed.
6.4 The Association reserves the right to immediately block access if the content of a publication on the platform is illegal or seriously violates netiquette. In less serious cases, the Association may request members to amend the publication. If this request is not complied with, access will be blocked. In cases of criminal content, the police will be informed.
6.5 In the event of breaches of obligations under sections 6.1 to 6.4, the Association has the right to claim damages. If internet access is blocked, the Association is not obligated to refund prepaid fees.
7. Safety
7.1 The Association undertakes to ensure security in systems, programs, etc., over which it has influence, in accordance with the current state of the art.
7.2 Members are responsible for the security of the systems, programs, and data under their control. In their own interest, members should keep passwords and usernames secret from third parties, change passwords regularly if necessary, and choose passwords that are not easily guessed.
7.3 Members undertake not to cause excessive strain on the platform through indiscriminate or improper distribution of data, in particular to refrain from spam mailings.
7.4 Members must refrain from archiving and distributing computer viruses.
7.5 In the event of breaches of obligations by members according to clauses 7.3 and 7.4, the Association may immediately block access without refunding any prepaid amounts and may demand compensation for damages.
8. Changes to the Terms and Conditions
8.1 The board of the Association may amend these terms and conditions at any time and without stating reasons, insofar as they concern the management and technology of the website.
8.2 The amended terms and conditions will be sent to members by email no later than two weeks before they come into effect.
